It would seem as though when you're grey(and I would assume red as well) the insta-rez menu doesn't pop up, I was wondering if this was by design, or if this was an implementation oversight, as in t2a the menu popped up no matter your color.

It should pop up no matter what as long as it isn't toggled off and the maximum amount of using it hasn't exceeded the limit.

I have never recieved an insta-rez pop up where is the option to turn it on?

Derrick will have to code a toggle command for it to be reactivated if it is currently disabled on your character. By default when this feature was added it was automatically disabled for characters with 700 skill points so that the current playbase wouldn't accidently do it when it was first released in the last patch.
