Mens Rea wrote:Dear Nancy Boy,

You are completely ignorant for these reasons:

"You are the one who tried to bring goodwill into the discussion when there clearly isn't a presence."

You will note I was making an analogy - "sold something *akin* to how you sell a business", "gold in the bank *could be seen as* an asset of the account as a whole". I'm sorry that you never learned to read, and being in the second year of your commerce degree isn't doing anything to change that. Please learn to read and understand when people are being figurative and reasoning by analogy. I never said he could argue the existance of goodwill in real life, rather, something akin to goodwill AS A REASON TO JUSTIFY ASKING FOR GOLD TO PURCHASE GOLD AS PART OF AN ACCOUNT. You seem to have missed this.

"Their is a service provided, and the consideration is equal to 0 in this case."

No. Consideration must have value. This is a fundamental principle of the formation of a contract. Contracts without valuable consideration are unenforceable. PS you are an idiot.

"So if litigation ever occured he is protected."

Litigation won't occur. Not in the jurisdiction of contract law, anyway. Please go and complete a law degree before trying to engage with me this subject. PS you are an idiot.

"I see where this is going, and it's only going to be a headache for me..."

Kind of like trying to tow a big load with a very small engine. Listen to it whine. PS you are an idiot.

"...so get your last word in..."

Okay here goes. PS you are an idiot.

"...but you are not confusing the people who know what they are talking about."

That's because so far I am the only one who knows what I/they are talking about. PS you are an idiot.
The fact you are taking this to heart goes to show your ignorance. Did you not read over Fair Market Value? The fact you can't even engage in an arguement professionally reveals to me you are going to some loser ass community college. Hence you are the idiot. I will let you think you won this one, goodluck getting a job:) Selling UO items and calling it goodwill holy shit. You should be embarrassed.

I know very well what goodwill is, you should take in consideration how you "account" for it.

Please see the meaning of "figurative" and "analogy", Nancy Boy. It might help you understand where you've made your biggest mistake - ie thinking that I was actually trying to account for good will.

Mens Rea wrote:I made a figurative comment that BeatingU could REASON BY ANALOGY to say he was demonstrating the overall value of his account to sell it akin to how you would sell a business. When you sell a company, for instance, you don't empty the bank accounts rather they are sold with the company. BeatingU could (AS AN ANALOGY TO SELLING A BUSINESS) argue (TO DERRICK) that he was selling his account for gold but mentioned the gold on the accounts to demonstrate the value of the accounts - so he could acquire a higher gold value through goodwill.
My eyes glaze over when I start reading legal jargon.

You are comparing a UOSA account to a business. This might be plausible if BeatingU was a merchant crafter that had vendors with operating capital, that were all included in the sale. I can't think of any reason why a banked gold and silver hoard would be sold in such a deal. Regardless, it seems like you are making quite a leap, and not an apples-to-apples comparison.

You are also trying to apply some real-world law to an in-game/forum issue. If real-world law applied here, all the reds and thieves would be locked up in yew prison. And everyone would be crying about it being a Trammel shard.

Sandro and Mens Rea, you guys might want to tone it down a bit if you want to keep this thread out of trash talk (which we should, it's got some valid points)

Hans, yea I know of the myriad of other ways to help out around here, and really the donations thing was hypothetical...I seriously doubted the ability to do the White Elephant auction in the first place, but I figured it couldn't hurt to ask.

Why is this not in trash talk by now? It certainly has devolved into it.......

Free Beatingu. He's good for the shard and misses playing here. Go read my post in second age discussion that addresses everything to do with the situation. And why using words like "likely" anD "probably" are in one mans eyes not the best reasons for handing out the harshest penalty possible on UOSA.

I'll paypal Derrick $5 usd for the shard for every person that puts "free Beatingu" in his signature. That's 5 dollars per sig for 1 week. Or I ask for my own account to be banned. Let's turn this situation into something positive forth shard! Let's fund raise!

LOL at beatingU being good for the shard.
LOL at comparing this debacle to some kind of real legal matter.
LOL at proto/beatingU defending themselves for this one.

All the stealing, scamming, trash talking and bullshit artistry has finally caught up with you. You even offered your accounts to me in game for a laughable amount of money. Just as laughable as these threads.

PS

LOL at Sandro talking legalese
