If OSI brought back an old server like that, they would start suing people to take down private shards.

There are shards that replicate OSI to present day...

Guys, it's EA. There's no possible way that they could do this correctly. Aside from that, let's see.... FREE TO PLAY Second Age shard, or $15/mo Second Age shard (with ingame cash shop that fucks up the economy). Hmmm, yea that's a tough one.

I doubt that a game developer that's been defunct for seven years now would be doing much of anything.

They're now owned by EA who are money grubbing bastards. And yes, there's precedent of this actually happening already:

Look at the bright side, EA is not Activision.
If they were, they would know how to do business and still capitolize on licensing.
Hell, EA really missed the boat when UOX first hit. They should have taken the opportunity to develop their own Admin version and sell server licenses to the likes of Derrick and myself (I used to goof around with shard admin).
Activision would be porting UO to an XBox Arcade game by now and pimping money out of the next generation for 15 year old disco-graphics.
I love this game and I highly doubt I will ever play another shard again, if I ever leave this one.
